“Contractor” – A third-party, independent tradesperson or company that has agreed to receive repair instructions via the Platform and to carry out works directly for Users.

“User” – Any individual, homeowner, landlord, or lawful occupier using the Platform to report a repair.

“Job” or “Repair Request” – The submission by a User detailing a required repair or issue to be resolved by a Contractor.

2. Scope of Services

2.1. RecoMend LTD operates a digital Platform designed to enable Users to report property repairs and to automatically allocate such Jobs to third-party Contractors vetted by us.

2.2. We do not carry out repairs. All works are performed independently by Contractors. We are not a party to the contract between you and the Contractor.

2.3. You acknowledge that the Contractor, and not RecoMend LTD, is solely responsible for:

  • The quality and completion of any work,

  • Timeliness of attendance,

  • Pricing and quotations,

  • Compliance with applicable regulations, safety, and standards.

3. Contractor Vetting and Insurance

3.1. We use reasonable endeavours to verify that Contractors:

  • Hold valid public liability insurance,

  • Are experienced and competent in their field,

  • Have no known history of misconduct or fraud.

3.2. We do not warrant or guarantee the performance, suitability, or reliability of any Contractor.

3.3. All insurance obligations remain with the Contractor. You are advised to request proof of insurance prior to allowing works to commence if desired.

4. Pricing and Quotations

4.1. All pricing and quotations are provided by the Contractor directly to the User. RecoMend LTD does not set, control, or guarantee the pricing of any Job.

4.2. It is your responsibility to confirm and agree the scope and cost of works before authorising any repair.

4.3. We accept no liability for disputes arising from pricing or work authorised by you.

5. User Responsibilities

By using the Platform, you agree to:

5.1. Provide accurate, complete, and truthful information regarding the property and issue being reported;

5.2. Cooperate with any Contractor assigned, including granting reasonable access to your property for inspections and works;

5.3. Not engage in abusive, harassing, or unlawful conduct toward Contractors or our staff;

5.4. Acknowledge that we are a referral and coordination service and not responsible for delays, miscommunications, or unsatisfactory outcomes related to the works performed.

6. Limitation of Liability

6.1. To the fullest extent permitted by law, RecoMend LTD shall not be liable to you for any direct, indirect, incidental, special, or consequential losses or damages (including, without limitation, loss of profits, business interruption, loss of data, or damage to property) arising out of or in connection with:

  • Your use of the Platform;

  • Any work performed (or not performed) by a Contractor;

  • The conduct or omission of a Contractor;

  • System downtime, unavailability, or data loss.

6.2. Our maximum aggregate liability to any User shall not exceed £100.

6.3. Nothing in these Terms shall exclude or limit our liability for death or personal injury resulting from our negligence or fraud.

7. Indemnity

You agree to indemnify, defend, and hold harmless RecoMend LTD, its directors, officers, employees, affiliates, agents, and licensors from and against any and all claims, liabilities, losses, damages, costs, or expenses (including legal fees) arising out of or in any way connected with:

  • Your use or misuse of the Platform;

  • Your breach of these Terms;

  • Any Job or repair works arising from your request.

8. Data Protection and Privacy

8.1. We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

8.2. Please refer to our Privacy Policy for details on how we collect, use, store, and protect your data.

9. Intellectual Property

9.1. All content on the Platform, including but not limited to logos, graphics, text, and software, is the property of RecoMend LTD or its licensors and is protected by intellectual property laws.

9.2. You may not copy, reproduce, or distribute any content without prior written permission.

10. Dispute Resolution

10.1. Any disputes or complaints regarding work carried out must be directed to the Contractor in the first instance.

10.2. While RecoMend LTD may, at its discretion, attempt to mediate disputes, we are under no obligation to do so and accept no responsibility for resolution.

11. Amendments to Terms

We reserve the right to amend these Terms at any time. Changes will be effective immediately upon publication on the Platform. Continued use constitutes acceptance of the amended Terms.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales. You agree to submit to the exclusive jurisdiction of the English courts.
